By accessing or using WhyCryBaby ("the Service"), including our website, web application, and mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and WhyCryBaby. By creating an account or using any part of the Service, you confirm that you are at least 18 years of age or the age of legal majority in your jurisdiction.

WhyCryBaby provides an AI-powered baby cry classification service. The Service analyzes audio recordings of baby cries to suggest possible reasons for crying, including hunger, pain, discomfort, tiredness, and the need for burping.

The Service is available through our web demo (without account registration) and through registered accounts that offer additional features such as analysis history, insights, and personalized recommendations.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

Some features of the Service require you to create an account. When creating an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for unauthorized purposes.

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

We do not guarantee the accuracy, completeness, or reliability of any analysis or classification provided by the Service.

To the fullest extent permitted by applicable law, WhyCryBaby and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service, including any analysis results
• Unauthorized access, use, or alteration of your transmissions or content
• Any actions taken or not taken based on the Service's analysis results

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

The Service, including its original content (excluding content provided by users), features, and functionality, is and will remain the exclusive property of WhyCryBaby and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain ownership of any audio recordings you submit to the Service. By submitting audio recordings, you grant us a limited, non-exclusive, temporary license to process the recording for the purpose of providing the classification service.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules.
